Terms and Conditions

§1 General Provisions

  1. The online store Crazyshapes.pl, available at the web address crazyshapes.pl, is operated by ONEE Sp. z o.o., registered in the National Court Register maintained by the Ministry of Justice, NIP 678-315-75-53, REGON 363209440, KRS 0000591488.
  2. These Terms and Conditions are addressed to both Consumers and Entrepreneurs using the Store. They define the rules for using the online Store, as well as the rules and procedure for concluding Sales Agreements with the Customer remotely via the Store.
  3. These Terms and Conditions specify in particular:
    1. the terms and conditions for making electronic reservations of products available within the online Store;
    2. the rules for concluding Sales Agreements using the services provided within the online Store;
    3. the terms and conditions for placing Orders electronically within the online Store.

§2 Definitions

The terms used in these Terms and Conditions shall have the following meanings:

  • Customer – a natural person, legal person, or organisational unit without legal personality that is granted legal capacity by special provisions, entering into an agreement with the Seller within the Store.
  • Seller – ONEE Sp. z o.o., registered in the National Court Register maintained by the Ministry of Justice, NIP 678-315-75-53, REGON 363209440, KRS 0000591488.
  • Store – the online store operated by the Seller at the web address crazyshapes.pl.
  • Sales Agreement – a sales agreement for Goods within the meaning of the Civil Code, concluded between the Customer and ONEE Sp. z o.o., entered into using the online service of the Store.
  • Terms and Conditions – these terms and conditions of the Store.
  • Order – a declaration of intent by the Customer submitted via the Order Form, aimed directly at concluding a Sales Agreement, specifying in particular the type and quantity of goods.
  • Order Form – an interactive form available in the Store enabling the placement of an Order.
  • Cart – an element of the Store software in which the Products selected by the Customer for purchase are displayed, and where the Order data, in particular the quantity of products, may be determined and modified.
  • Goods – products presented in the online Store.
  • Civil Code – the Act of 23 April 1964 (Journal of Laws 1964 No. 16, item 93, as amended).
  • Consumer Rights Act – the Act of 30 May 2014 on consumer rights (Journal of Laws 2014, item 827, as amended).

  6. The Customer may contact the Seller by telephone between the hours of 9–16.

§4 Technical Requirements

In order to use the Store, including browsing goods and placing orders, the following are required: a device with Internet access and a web browser, an active email account, and cookies enabled.

§5 General Information

  1. The Seller shall not be liable for any disruptions, including interruptions in the functioning of the Store, caused by force majeure, unauthorised actions of third parties, or incompatibility of the online Store with the Customer's technical infrastructure.
  2. Browsing goods in the Store does not require creating an Account. Placing orders by the Customer for Goods available in the Store's assortment is possible by providing the necessary personal and address details, which enables the fulfilment of the Order.
  3. Prices listed in the Store are quoted in Polish zloty and are gross prices, inclusive of VAT.
  4. The final amount payable by the Customer includes the price of the Product and the delivery cost (including transport, delivery, and postal service charges), of which the Customer is informed on the Store's pages during the placement of the Order.
  5. Information provided on the Store's website, including information about the presented products, and in particular their descriptions, technical and functional specifications, as well as prices, constitute an invitation to conclude an agreement within the meaning of Article 71 of the Civil Code.
  6. Each Customer placing an order consents to receiving, at the email address they have provided, information related to the progress of the transaction, as well as notifications about changes to the Store's Terms and Conditions.
  7. The Store enables the purchase of products and services 24 hours a day, 7 days a week.

§6 Order Placement Procedure

In order to place an Order, the following steps are required:

  1. Select the Product that is the subject of the Order, then click the “Add to cart” button (or equivalent).
  2. Complete the Order Form by entering the details of the Order recipient and the address to which the Goods are to be delivered.
  3. Enter invoice details, if different from the Order recipient's details.
  4. Select one of the available payment methods and pay for the order.
  5. Accept the Terms and Conditions.
  6. Click the “Pay” button.
  7. The agreement shall be deemed concluded upon the Customer's receipt of an email confirming the placement of the order.
  8. If the Customer fails to pay for the order within 72 hours of purchase, the Seller reserves the right to cancel the order.

§7 Delivery and Payment Methods

  1. The Customer may use the following delivery methods for the ordered Product:
    1. postal shipment,
    2. courier shipment.
  2. The Customer may use the following payment methods:
    1. bank transfer to the Seller's account,
    2. electronic payments (PayNow),
    3. payment by credit/debit card,
    4. BLIK.
  3. Delivery of Goods is carried out within the territory of the Republic of Poland.
  4. Delivery of the Product to the Customer is subject to a charge, unless the Sales Agreement provides otherwise. The delivery costs of the Product are indicated to the Customer during the placement of the Order.
  5. The Seller shall make every effort to ensure that the delivery time for orders is as short as possible. In the event of a delay, the Seller shall promptly inform the Buyer of this fact.
  6. The Buyer has the right to assess the condition of the goods and their conformity with the order in the presence of the delivery person. In the event of damage to the goods, a complaint report describing the damage shall be drawn up in the presence of the Courier. The goods subject to the complaint, together with the sales document, shall be returned to the Courier.
  7. The cost of delivery depends on the volume of goods and is displayed when placing the order. The delivery cost is binding at the time the order is placed.
  8. Upon receipt of the goods, the Buyer is obliged to confirm their receipt.

§8 Performance of the Sales Agreement

  1. The conclusion of the Sales Agreement between the Customer and the Seller takes place after the Customer has previously placed an Order using the Order Form in the online Store in accordance with §6 of the Terms and Conditions.
  2. After placing and paying for the Order, the Customer receives an email confirming the placement of the order. Upon the Customer's receipt of the above email, the Sales Agreement between the Customer and the Seller is concluded.
  3. In the case of an order for Products with different delivery times, the delivery time shall be the longest specified period.
  4. In the case of an order for Products with different delivery times, the Customer may request delivery of the Products in parts or delivery of all Products after the entire order has been completed.
  5. The delivery period for the Goods to the Customer shall commence from the date the Seller's bank account is credited.

§9 Right of Withdrawal

  1. The Customer, being a consumer within the meaning of Article 22[1] of the Civil Code, has the right to withdraw from a distance contract without providing any reason within 14 days from the date of receipt of the goods.
  2. In order to withdraw from the agreement, a relevant statement shall be submitted in writing or by email to sklep@crazyshapes.pl.
  3. In the event of withdrawal from the agreement, the agreement shall be deemed not to have been concluded. The Goods shall be returned in an unchanged condition. The return shall be made without delay, no later than within 14 days.
  4. After contacting sklep@crazyshapes.pl, the appropriate shipping address will be provided.
  5. The goods returned by the Customer should be packed in an appropriate manner to ensure no damage to the shipment during transport.
  6. In the event of withdrawal from the agreement, the Store shall refund the payment received from the Customer without delay, no later than 14 days from the date on which the goods were returned. The refund shall be made using the same payment method that was used by the Customer in the original transaction, unless the parties agree otherwise.
  7. The right to withdraw from a distance contract shall not apply to the Consumer in respect of an Agreement:
    1. in which the subject of the service is a non-prefabricated item, produced according to the Consumer's specifications or intended to satisfy their individualised needs,
    2. in which the subject of the service is an item delivered in a sealed package which, after opening, cannot be returned for health or hygiene reasons, if the package was opened after delivery,
    3. in which the subject of the service is an item which is subject to rapid deterioration or has a short shelf life.
  8. To withdraw from the agreement, the Consumer may use the following model withdrawal form (this form is not mandatory):

§10 Complaints and Returns

  1. In the event that a purchased product is not in conformity with the agreement or has physical defects, the Customer has the right to file a complaint based on:
    1. the regulations set out in the provisions of the Act of 27 July 2002 on specific conditions of consumer sales and amendments to the Civil Code (Journal of Laws No. 141, item 1176, as amended), in the event that the product is not in conformity with the agreement,
    2. the regulations set out in the provisions of the Civil Code regarding warranty for defects.
  2. Complaints shall be submitted in writing to the address specified in the Terms and Conditions or electronically to sklep@crazyshapes.pl.
  3. It is recommended that the complaint include, among other things, a brief description of the defect, the circumstances (including the date) of its occurrence, the details of the Customer filing the complaint, and the Customer's demand in connection with the defective goods.
  4. When specifying demands based on the procedure provided for in point 1a), the Customer has the right to request that the product be brought into conformity with the agreement. If the Seller is unable to fulfil the specified demands, the Customer has the right to demand an appropriate reduction of the price or may withdraw from the agreement.
  5. The Store shall be liable for non-conformity of a consumer product with the agreement only in the cases and under the conditions specified by law.
  6. The Seller shall respond to the complaint without delay, no later than within 14 days.
  7. The Seller reserves the right to refuse to accept a complaint in the event of any modifications to the product made by the Customer, sole fault of the user, mechanical damage, improper maintenance, and use of the product contrary to the instructions.
  8. After filing a complaint, the Customer will be provided with the appropriate shipping address.

§11 Personal Data in the Online Store

  1. The controller of personal data of Customers collected through the online Store Crazyshapes.pl is ONEE Sp. z o.o., ul. Rakowicka 20A/66, 31-510 Kraków, NIP 678-315-75-53, REGON 363209440, KRS 0000591488.
  2. The data collected by the Seller includes data voluntarily provided by the Customer. Personal data of Customers collected through the online Store are collected for the purpose of performing the Sales Agreement, and if the Customer consents – also for marketing purposes.
  3. The recipients of personal data of the online Store's Customers may be:
    1. In the case of a Customer who uses postal or courier delivery in the online Store, the Controller shall disclose the collected personal data of the Customer to the selected carrier or intermediary fulfilling shipments on behalf of the Controller.
    2. In the case of a Customer who uses electronic payment or payment by card in the online Store, the Controller shall disclose the collected personal data of the Customer to the selected entity handling the above payments in the online Store.
  4. The Customer has the right to access the content of their data and to rectify it.
  5. The Controller shall not be liable for the provision of untrue or incomplete personal data by the Customer.
  6. The provision of personal data is voluntary; however, failure to provide the personal data specified in the Terms and Conditions that is necessary for the conclusion of the Sales Agreement shall result in the inability to conclude such agreement.
  7. With the additional consent of the Customer, the collected personal data may also be used for promotional and marketing purposes, in particular for the purpose of presenting the Customer with commercial offers of the Store and other marketing information related to the Store.
  8. The Store uses, among other things, so-called “cookies”, which contribute to greater usability, functionality, and ease of use of the Store. Detailed rules for the use of cookies are set out in the Cookie Policy available on the Store's website.

§12 Final Provisions

  1. Agreements concluded through the online Store are concluded in the Polish language.
  2. The Seller reserves the right to amend the Terms and Conditions for important reasons, namely: changes in the law, changes in payment and delivery methods – to the extent that these changes affect the implementation of the provisions of these Terms and Conditions. The Seller shall inform the Customer of any changes at least 7 days in advance.
  3. All content contained in the Store is legally protected and its use shall constitute an infringement of the law.
  4. In matters not regulated by these Terms and Conditions, the provisions of Polish law shall apply, in particular: the Civil Code and the provisions of the Act on the Provision of Electronic Services, the Consumer Rights Act, the Data Protection Act, and other applicable provisions of generally binding law.
  5. The Customer has the right to use out-of-court methods of handling complaints and pursuing claims. To this end, the Customer may file a complaint via the EU online ODR platform available at: ec.europa.eu/consumers/odr.
